("Olakai", "we", "us", or "our"). By accessing or using either Site, you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, please do not use the Sites. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Sites following any changes indicates your acceptance of the new Terms.

Shadow AI Map is an AI tool directory that catalogs assistive AI applications and provides automated risk analysis, EULA assessments, compliance data, pricing information, and community reviews. Risk scores, classifications, and compliance indicators are generated through automated processes and are provided for informational purposes only.

Both Sites are provided free of charge as educational and informational services. While we strive for accuracy, the content is for informational purposes only and is not a substitute for independent legal, security, compliance, or professional review. Shadow AI Map provides risk scores, risk levels, enterprise readiness indicators, and other assessments for AI tools listed in its directory. You acknowledge and agree to the following:

Risk scores may change at any time as new information becomes available or as our methodology evolves. Past scores are not indicative of current tool risk profiles.

Shadow AI Map uses automated artificial intelligence systems (large language models) to analyze the terms of service, privacy policies, and other legal documents of listed AI tools. This analysis is subject to the following important limitations:

Third-party vendors may update their terms of service, privacy policies, or data practices at any time without notice to Olakai. Our analysis may not reflect the most current version of any document. You are solely responsible for reviewing the current terms of any tool you use or consider using.

If you are a vendor, developer, or authorized representative of a tool listed on Shadow AI Map and believe that your listing contains inaccurate information, you may contact us at support@olakai.ai with specific details about the claimed inaccuracy.

Olakai will review disputes in good faith but reserves final editorial discretion over all content, scores, and analyses published on the Sites. We are not obligated to modify, remove, or update any listing, score, or analysis based on a vendor request.

Olakai may provide application programming interfaces (APIs) or data export functionality that allow authorized third parties to access tool data, risk scores, and related information. All data accessed via API or data export is subject to the same disclaimers, limitations, and restrictions set forth in these Terms.

The content on the Sites is provided for general informational and educational purposes only. It is not intended as, and should not be construed as, professional legal, security, compliance, or procurement advice. You should not rely solely on information from the Sites for making business, security, or compliance decisions.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.

We may also update these Terms from time to time to reflect changes in our practices or for legal, operational, or regulatory reasons. We will indicate at the top of this page the date these Terms were last updated. Your continued use of the Sites after any changes indicates your acceptance of the updated Terms.

If we make material changes to these Terms, we will provide notice through the Sites or via email (if you have provided us with your email address).

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration in San Francisco, California, using the English language in accordance with the Arbitration Rules and Procedures of Judicial Arbitration and Mediation Services, Inc. (JAMS) then in effect.

The arbitration shall be conducted by one arbitrator. Judgment upon the award rendered may be entered in any court of competent jurisdiction. Notwithstanding the foregoing, Olakai may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights.

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Olakai regarding the use of the Sites and supersede any prior agreements.

Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Olakai's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms or your rights hereunder, in whole or in part, without our prior written consent. Olakai may assign these Terms at any time without notice to you.
